Thus, in order to be legally concluded, a contract for the selling or the purchasing of a property must take the authentic form. So, in this situation, it is imperative to conclude the convention in front of a notary public, because, otherwise, the validity of the contract will be questioned.

You can also fill in a Pre-Contract of Sale and Purchase, in front of a notary public; this option has the advantage of being cheaper.

Later, you can go to the Court of Law ( Judecatorie- The First Court, Tribunal and Court of Appeal) to issue a decision that takes the place of contract of sale and purchase, avoiding to pay  a sum of  money to the notary public.

Before putting down such an agreement, it is necessary to verify the validity and accuracy of the original documents of property. This may be made by a lawyer or a notary public and, in many cases, this piece of advice does not cost anything. For example, advice will be free of charge when the documents that will confirm this Convention shall be prepared in the same notary office.

Many property owners already own the property history that they want to alienate, because they got it when they acquired that property.

This history indicates all the owners of the property that was taken.

After that the land owner obtained the file meant to show the exact area of land or house, he may obtain the financial extract from the fiscal administration.
